Building an Accessory Dwelling Unit (ADU) to Use as an Airbnb

You’ve done some digging, and you've learned that in Portland, Airbnb hosts must occupy their residences for at least 270 days during each calendar year. If they do not, their permits can be revoked. This raises the question, can an Accessory Dwelling Unit (ADU) still be used as an Airbnb?

Just a quick recap: An ADU is a structure built on a property that already has a house. It must be smaller than said house. And, to be classified as an ADU, it must have a place to sleep, a kitchen, and a bath. Considering these requirements, you can see why ADUs would be perfect for short term rentals!

Although Portland has some clauses that help with building ADUs for long-term rentals, it’s among the stricter cities when it comes to short-term Airbnb rules and regulations. Thankfully, unlike some other cities in Oregon, such as Salem, you can still use your ADU for short-term rentals in Portland! There is just a lot you need to know to stay in compliance with the city.
For long term rentals, Portland currently has a program that waives the extensive building permits associated with building some ADUs. These rules don’t apply to short-term rentals. For those, you’ll generally need to pay full price for permits, particularly when the ADU is a brand-new structure. These can be very costly and add up very fast!

If you have a property you are planning to build a ADU on, you’ll need to get a permit from Portland’s Central Planning Bureau. You’ll also need to get the permit approved by Portland City Council and then you’ll usually need approval from the Zoning Administrator as well. The process can take days or months, depending on how busy they are.

What permits you need will also change depending on if your ADU is attached to your house or not. Free standing ADUs have significant more requirements and are typically more expensive than converting a garage or adding a unit onto your existing home.

If you purchased a home that comes with an ADU or otherwise already have one, you will be happy to know you can list it on Airbnb for short term rentals. You will need to apply to all of those necessary permits as well, including getting a business license, but it can be a great way to supplement your income.

Please note that you will be required to notify your neighbors that you plan on renting out your ADU as an Airbnb. They may even possibly get in the way of you being granted your permits if they complain or otherwise express that they do not want a short-term rental unit in their neighborhood to the city.

Finally, you still also must abide by any other regulations, such as if you live in a HOA.

The virtual program includes entertainment, stories from Jean’s Place participants, an online auction going live March 30th, and the opportunity to donate and help fund their vital programs and services.
